Please read these Terms of Use carefully before using the Herbix AI mobile application ("Application"), operated by the Herbix AI Team ("we," "us," or "our"). By downloading, installing, or using the Application, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Application.
By accessing or using Herbix AI, you confirm that you are at least 4 years of age (or of the minimum age required in your jurisdiction), have the legal capacity to enter into these Terms, and agree to comply with all applicable laws and regulations. If you are using the app on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Disclaimer: Plant identifications, health scores, and care recommendations provided by Herbix AI are generated by AI for informational and guidance purposes only. They do not constitute professional horticultural, agronomical, or botanical advice. Results are based on algorithmic image analysis and may vary. Always consult a certified plant specialist for critical agricultural or horticultural decisions.
We may offer a free trial period for new subscribers. At the end of the trial, your subscription will automatically begin and you will be charged the applicable subscription fee unless you cancel before the trial ends.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price as your current plan. You can manage and cancel your subscription at any time through your App Store account settings.
We reserve the right to change subscription pricing. We will provide reasonable advance notice of any pricing changes. Continued use of the app after a price change constitutes acceptance of the new pricing.
All subscription purchases are processed through the Apple App Store or Google Play Store. Refund requests are subject to the respective store's refund policies. We do not control refund decisions made by Apple or Google. For refund requests, please contact Apple Support or Google Play Support directly.

All content, technology, AI models, software, text, graphics, and branding within the Application are owned by or licensed to Herbix AI and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our proprietary content without express written permission.
You retain ownership of photos you submit to the Application. By submitting photos, you grant Herbix AI a limited, non-exclusive, royalty-free license to process your photos solely for the purpose of providing the plant identification and health analysis service. We will not use your photos for any other purpose without your consent.
Important Notice About AI Analysis:
Your use of the Application is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Application, you consent to the collection and use of your information as described in our Privacy Policy.
The Application is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the fullest extent permitted by applicable law, Herbix AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Application, including but not limited to loss of plants, crop damage, financial loss, or reliance on AI-generated care recommendations.
You agree to indemnify and hold harmless Herbix AI and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Application, violation of these Terms, or violation of any rights of a third party.
We reserve the right to suspend or terminate your access to the Application at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or for any other reason. Upon termination, your right to use the Application will immediately cease.
These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising under these Terms shall be resolved through binding arbitration, except where prohibited by law.
We reserve the right to modify these Terms at any time. We will notify users of material changes through the Application or via email. Your continued use of the Application after changes become effective constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
